Warranty


Limited Warranty: TVH warrants that the products it manufactures and distributes are free from defects in materials and workmanship under normal use. This warranty is made for a period of one year, or as indicated from the date of original sale. (Some parts and products are applicable to 90 day warranty.) TVH will repair or replace any items sold that proves defective in material or workmanship without charge. The defective item must be returned, freight prepaid to TVH with proof of purchase and a brief explanation of defect.

Any implied warranties covering the product, including warranties of merchantability or fitness of purpose, are limited to a duration of ninety (90) days, one year or as indicated from the date of purchase. An implied warranty of merchantability means that the product will work normally. An implied warranty of fitness means that the product is suitable for the use of which it was advertised. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

TVH SHALL NOT IN ANY CASE BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM BREACH OR WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY EVEN IF TVH OR OUR AGENT HAS BEEN ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES. This means we are not responsible for any costs incurred as a result of lost profits or revenue. Some states do not allow the exclusion or limitation of incidental or consequential damages so the above limitation or exclusion may not apply to you.

This warranty allocates risks of product failure between you and TVH. Our pricing reflects this allocation of risks and the limitation of liability contained in this warranty. The warranty set forth above is in lieu of other express warranties, whether oral or written. The agents, employees, distributors and dealers of TVH are not authorized to make modifications in this warranty or additional warranties binding on TVH. Accordingly, additional statements, such as dealer advertising or presentations whether oral or written, do not constitute warranties and should not be relied upon.

This warranty gives you special legal rights and you may have other rights which vary from state to state.
